Definition
Human oversight encompasses the organizational structures, technical mechanisms, and procedural safeguards that enable qualified individuals to monitor AI system behavior, intervene when problems arise, and override or reverse AI-driven decisions when necessary. Effective human oversight ensures that AI systems remain tools under human control rather than autonomous actors operating beyond accountability.
Article 14 of the EU AI Act establishes human oversight as a mandatory requirement for high-risk AI systems. The regulation specifies that these systems must be designed to enable natural persons to effectively oversee their operation, with capabilities including understanding the system's capacities and limitations, remaining aware of automation bias, correctly interpreting outputs, and deciding when and how to intervene or override. The EU AI Act recognizes three levels of human oversight, each appropriate for different risk contexts. Human-in-the-loop (HITL) requires human approval for each decision before it takes effect. Human-on-the-loop (HOTL) allows the system to operate while humans monitor and can intervene in real-time. Human-in-command (HIC) gives humans the authority to set policies, review samples, and handle exceptions without reviewing every individual decision. High-risk systems must implement oversight measures proportionate to their risk level and operational context. Critically, Article 14 also requires that persons responsible for oversight be competent, properly trained, and given the authority and resources to fulfill their role. Oversight is not merely a technical feature but an organizational commitment with documented responsibilities.
Implementing compliant human oversight requires both technical infrastructure and operational processes. On the technical side, organizations need mechanisms that surface AI decisions for human review, queue actions awaiting approval, enable intervention and override, and capture documentation of oversight activities. On the operational side, organizations must define oversight roles, establish escalation procedures, train personnel, and allocate sufficient resources to prevent oversight from becoming a bottleneck.
The documentation burden is significant. For each oversight action, organizations should record who reviewed the decision, what information was available to them, what action they took, and why. This evidence demonstrates that oversight was not merely theoretical but actually exercised in practice. Organizations must balance oversight thoroughness with operational efficiency. Reviewing every low-risk decision is neither required nor practical, but high-risk decisions affecting individuals' fundamental rights demand careful human judgment. The key is matching oversight intensity to decision risk through well-designed approval workflows and escalation criteria.
